Deleting Google rating / review
60% of all online customers state that online ratings influence their purchases. 88% of consumers trust online ratings as much as personal recommendations. Today Google ratings have great impact on a product and business as they form the basis of decisions for potential customers.
Even when as a seller you can point to several positive product reviews, it is annoying when a pontential customer shies away from buying one of your products because of a few bad reviews. As opposed to a potential customer who can view a product at a store, a potential online customer has to rely on online descriptions and experiences. Interested people focus first on the negative reviews to get a clear picture and then decide if they will purchase the product or not.
That leaves the seller with the question: how can negative ratings/reviews be deleted? There are several steps that need to be taken to achieve this.
1. Step-Warning
The first step to deleting ratings and reviews is: a legal warning letter to the person who submitted the rating, if they are known by name.
Such a letter from a lawyer can often yield good results. Many customers do not let it come to judicial confrontation.
Ideally, the customer can convert a negative review into a positive one so that their review average no longer suffers. If a correction is no longer possible, the customer can delete the rating / review.
2. StepContacting Google
If the warning is unsuccessful, the next step can be taken: the lawyer contacts Google directly.
Here we are in contact with an Irish lawyer in Dublin to intervene on the spot if necessary.
Since reviews and ratings must be related to buying experience and must adhere to guidelines, the lawyer can inform Google about a rating / review's violation of the review guidelines and applicable law.
When are review guidelines violated?
Reviews are not permitted if the following content is involved:
-Advertising, spam or wrong content
-Non-themed content
- Illegal or restricted content
-Sexual or offensive content
- insults, harassment and bullying
-Identity theft
-Conflict of interest
When are there violations of applicable law?
1. Untrue claims based on facts
2. Evil- accusation of a contemptible quality or attitude or
dishonorable behavior, or behavior against good morals.
3. Defamation - In the event of defamation, someone is suspected of committing a criminal act, although it is clear that the allegation is false and the person is at risk of being persecuted by the police or public prosecutor.
4. Disgraceful reviews that aim at disparaging a person and do not deal with the matter.
5. Insult-The abuse or mockery of one person in front of at least two others
Costs: For the 1st and 2nd step we charge a flat fee of EUR 200.
3. Step- Lawsuit/ Injunction
If the rating / review is not deleted despite warning and contacting Google, only one step remains: a lawsuit!
Both the person who submitted the rating and Google can be sued for damages in this matter.
In particularly urgent cases, we can also file for an injunction, which if granted, leads to an immediate deletion within about one to four weeks.
Costs: Billing is governed by the Solicitors Tariff Code; However, in order to initiate the legal proceedings, we only need the court fee of EUR 743. If successful - we will give you an accurate and reliable estimate - you will receive the court fee back from the opponent. Normally (in case of victory), the litigation should therefore be free of charge for you.
