Deleting Mjam Rating/Review


Who hasn't ordered food online today! Especially if you don't have time or want to cook, or if it raining and the restaurant is too far, you can reserve to online food delivery. In Austria the delivery service Mjam can offer you what you need. If you as a restaurant owner also take orders through Mjam
you are also dependent on customer reviews. Of course it will happen that you will not get only positive reviews. Many customers are brutally honest and not conscious what kind of consequences their ratings have. Negative ratings can spoil every cook's broth, because your average rating drops.

Even when you as a restaurant owner can point to several positive product reviews, it is annoying when a pontential customer shies away from ordering from you because of a few bad reviews. 
As opposed to a potential customer who can dine at a restaurant, a potential online customer has to rely on online descriptions and experiences. Interested people  focus first on the negative reviews to get a clear picture and then decide if they will place an order or not.  

That leaves the restaurant owner with the question: how can negative ratings/reviews be deleted? There are several steps that need to be taken to achieve this. 

1. Step-
Warning  

If we take a case, we take the first step:Legal warning letter to the person who has submitted the rating, if they are known by name. 

Usually success can already be achieved through such a warning. 

Many customers do not let it come to  judicial confrontation.

2. Step-
Contacting Mjam

If the warning is unsuccessful, the next step has to be taken: the lawyer contacts Mjam directly.

Since reviews and ratings must be related to buying experience and must adhere to guidelines, the lawyer can point out the violations of a rating / review according to Mjam review guidelines.

However, the violation only applies to formally inappropriate or fraudulent contributions. If you consider the evaluation received as "unfair", it is not a sufficient reason .


When are review guidelines violated?

Reviews and ratings are not permitted if they:

- Include insulting, belittling, defamatory, vulgar, racist or sexist content or adult formulations

- Threaten or glorify violence

- Are not related to your meal order

- Contain links or advertising messages, interfere with the copyright, data protection or other rights of third parties, or contain private or confidential information.


Costs: For the 1st and 2nd step we charge a flat fee of EUR 200.

3. Step- 
Lawsuit and injunction

If there is still no success despite the previous efforts, there remains only one more step: a lawsuit!
Here legal action can be taken against, both the person who submitted the rating and Mjam. 

In particularly urgent cases we can also request an injunction, which if granted, leads to an immediate deletion within about one to four weeks.

Costs: Billing is governed by the Solicitors Tariff Code; However, in order to initiate the legal proceedings, we only need the court fee of EUR 743. If successful - we will give you an accurate and reliable estimate - you will receive the court fee back from the opponent. Normally (in case of victory), the litigation should therefore be free of charge for you.
