When can I come and visit?

Each detainee is allowed to receive visitors at least once a week for 30 minutes. A maximum of 2 adults are allowed to visit at a time, and children only when accompanied by an adult. There are visiting times that are set according to the Initial letters of the last name of the deportee.

What is detention pending deportation?

Deportation detention is a term that describes arrest of a foreign person in Austria in order to expel this person from the country. Detention pending deportation is imposed by the authorities if a deportation order has been issued or if the person is to be expelled from the country for other reasons. Detention pending deportation is not a criminal detention.

Can I bring something?

Yes.
Clothes, books or magazines, games, televisions (maximum 60 cm) and radios, as well as money can be handed over after they have been checked by police officers. Money is always put into the deposit and can every Monday. Electronic games and recording devices are prohibited.

ATTENTION: Withdrawing money is only possible on Mondays. So if you bring the money on Tuesday or Wednesday, the deportee will not be able to access the money until the following Monday.

Can I bring food and drinks?

No.
Food and drink are provided in the detention center. There is a canteen for other drinks and food as well as everyday items.

What is permitted in detention pending deportation?

Every person in detention has rights and also the opportunity to complain about any grievances. Every day during the week (Mon-Fri) from 15:00-16:00 the Social care team comes to the PAZ Rossauer Lände. Questions can be asked there and complaints can also be made.

Contacting your lawyer is always possible.

In detention there are various rules and rights that apply to everyone. What you are allowed to have in your room, how you are allowed to pass the time, when and how you are allowed to practice your religion are all precisely regulated. The Federal Ministry of the Interior has an information document which describes these rights and rules.

What options for complaint (legal remedies) do I have?

You have the opportunity to lodge a written complaint against the detention pending deportation if you believe that the detention is unlawful (wrong).

However, there are often various formalities that need to be observed, which the BFA does not always adhere to. So, surprisingly, a complaint often pays off!

You have the right to lodge a complaint throughout the entire period of detention pending deportation and also for six weeks after the end of the detention pending deportation.
