Afghan receives humanitarian visa after a long wait at the Federal Asylum Court


Mr. S comes from Afghanistan and lodged an asylum application end of December 2014. In its decision from April 2017 the Federal Asylum Office (FAO) rejected the application, did not grant him subsidiary protection, and concluded that his deportation to Afghanistan was permissible. The FAO argued that his asylum grounds were not credible, he had family members in Afghanistan, and also had an alternative flight option in Kabul. 

In April 2017 he lodged an appeal to the Federal Asylum Court (FAC). As the FAC had not decided within the legally stipulated time frame, Mr. S. had to file a complaint of lateness in November 2018. After the hearing in Januar 2019 the FAC granted Mr. S. a humanitarian visa (residence permit plus).

The FAC argued that the visa was to be issued on basis of his long duration of stay in Austria, his integration measures, and his integrity of character
