In principle, every adult in Austria is authorized to represent themselves. If, however, due to mental illness or the like, it is no longer possible to make all decisions yourself, there is the option of adult representation. Depending on the severity of the illness, this then takes on some or all of the tasks for the person to be represented. What forms of adult representation are there?
1. The elected adult representative: Under certain conditions, a person who is no longer fully capable of acting can elect their own adult representative.
2. Statutory adult representation (before 2018: power of representation for next of kin): This can be considered if there is no health care proxy and the selected adult representation is no longer an option.
3. Judicial adult representation (before 2018: guardianship): If no other form of representation is possible, for example because there are no relatives available or the form of representation is too complex, judicial adult representation comes into play.
What is a Power of Attorney?
With this you can be sure that if the situation arises that you can no longer determine what happens to you or you can no longer represent yourself, that you have appointed an adult representative in advance who will then represent your interests. What are the next steps if I want to change the adult representative?

3. We draft and submit the written statement. The old substitution expires and the new substitution begins.
